THIS AGREEMENT GOVERNS YOUR PURCHASE OF PRODUCTS FROM CDDVDKING, LLC. PLEASE READ IT CAREFULLY. NO OTHER TERMS APPLY. BY SUBMITTING YOUR ORDER YOU ARE AGREEING TO THESE TERMS.
Definitions: “Product(s)” shall mean any item offered for sale on the CDDVDKING, LLC website.
Entire Agreement:
The Terms and Conditions herein may NOT be altered, supplemented, or amended by the use of any additional document(s) that purport to be an agreement of the parties. Any attempt to supplement or amend these terms and conditions or to enter an order for Product(s) which is subject to additional or altered terms and conditions shall be null and void.
Orders/Acceptance by CDDVDKING, LLC:
All orders of Product(s) are non cancellable and shall be subject to acceptance by CDDVDKING, LLC. CDDVDKING, LLC reserves the right to reject any order and to limit the quantities of any order. Notwithstanding any order confirmation or other communications sent by CDDVDKING, LLC, all orders shall not be deemed accepted by CDDVDKING, LLC until shipment of the Product(s) ordered. Your submission of an order shall constitute your full acceptance of these terms and conditions. IF YOU DO NOT ACCEPT THESE TERMS, PLEASE DO NOT SUBMIT AN ORDER.
International Orders:
We regret that we cannot accept credit cards from outside the United States due to a high rate of fraud from certain countries. Our international customers pay by bank wire transfers because of their immediacy. Wire transfers should be made payable to CDDVDKING, LLC in US dollars. There is a $25.00 wire transfer fee that will be added to your order. The customer is responsible for all duties, taxes and charges by the country of destination. Our low prices preclude us from paying any International freight charges for either warranty or non-warranty work.
USA Customers:
We offer our customers the opportunity to pay with credit cards, company check, and bank check or wire transfers. We can only ship to the billing address on the credit card. We reserve the right to have you sign a Credit Card Authorization form and fax it to our office. This would include your signature and a facsimile of the credit card. Under certain circumstances we will accept purchase orders from our corporate customers after the second order. Terms if given are Net 15 days. Terms will be given after a company fills out a credit application that will include three verifiable trade references and the agreement to our terms.
Limited Warranties:
CDDVDKING, LLC makes no warranties on the Product(s). The Product(s) are sold AS IS. The manufacturer of the Product(s) may offer its own warranties and you agree to look solely to such manufacturer for any warranty-related claims. CDDVDKING, LLC EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY IMPLIED WARRANTIES OF NON-INFRINGEMENT. It is the customer's responsibility to review the warranty terms upon receipt of the product. Most warranties are one year. Print heads, printer ribbons and ink cartridges carry no warranty and are considered consumables by manufacturers. Asus CD-Rom & DVD-Rom readers carry a six-month warranty. CD-RW and DVD-RW Drives carry a 12 month warranty and duplication tower controllers carry a one year warranty. Consult the individual product specifications to determine the warranty on your print head. Extended warranties are available on most Products. Call 303-670-3234 for details. CDDVDKING, LLC does not warrant the Products sold, unless specifically indicated as manufactured by CDDVDKING LLC.
Product(s):
CDDVDKING, LLC continually updates and revises its Products. CDDVDKING, LLC may update and/or discontinue Products at any time. Changes in Products shipped and Products described on the CDDVDKING, LLC are possible.
Returns:
General Returns:
CDDVDKING, LLC does not offer a return on any Product, including without limitation automated systems, towers, thermal or inkjet printers or packaging equipment or packaging supplies or any hardware or printing supplies. ALL SALES ARE FINAL. If such Products are returned and accepted by CDDVDKING, LLC, they are subject to a 25% restocking fee for duplication and printing equipment and 50% for packaging equipment. Shipping fees are non-refundable. Return shipping fees are the responsibility of the customer. Any supplies used will have to be paid for by customer. Partial packages will have to be restored to original condition that may result in additional charges. Products must be returned in original packaging and condition. Original manuals and accessories must be included in the return. If Products and Packaging are not returned in "like new" condition the customer will be charged accordingly to bring the Packaging and Products back to like new condition in addition to the Restocking Fee. Physical damage to a Product must be reported within 3 business days of receipt of the Product. Physical damage to any Products not caused by shipping in not covered by any warranty. Customers who have purchased online or customers who have signed our invoice agreeing to our terms who attempt charge backs to defraud CDDVDKING will automatically be charged or billed a $250.00 rebuttal fee per chargeback attempt on their credit cards to cover any of the following fees: legal, bank, credit card and miscellaneous.
Defective Products
Defective Products may be repaired or replaced by the manufacturer directly and must be returned directly to the manufacturer. CDDVDKING, LLC does not accept the return of defective Products not manufactured by CDDVDKING LLC. Defective Products must be returned to the manufacturer. All Products to be returned are subject to the following:
1.The customer must obtain a Return Merchandise Authorization (RMA) number. Consult the manufacturers website for details or you may request CDDVDKING, LLC assistance in securing a Return Merchandise Authorization number by calling 303-670-3234 or e-mailing sales@cddvdking.com. Most hardware manufacturers prefer to have RMA handled online.
2.RMA numbers are valid for 7 business days and the manufacturer must receive the Products within 7 days from the issuance of the RMA number.
3.The RMA number must be clearly written on the cartons shipping label (NOT ON THE BOX ITSELF). Writing on the box will result in charges for new packaging. If the RMA number is not clearly marked on the outside of the shipping label, the carton will be refused and returned to the sender.
4.Shipping charges are not refundable.
5.All returned Products must be insured and must be sent to the directly to the manufacturer.
6.The cost to return the Products to the manufacturer will be paid by the customer. The cost to return working Products to the client will be paid by the manufacturer. CDDVDKING LLC does not pay for the return shipment of Products manufactured by CDDVDKING LLC. A check or money order must accompany any returned Products to pay for return shipments.
7.Serial numbers for returned Products must match the invoice.
8.All returns must be in original packaging. If original packaging is not available you must contact the manufacturer to obtain original packaging. If items are returned in anything other than the manufacturers original packaging, you will be charged to restore packaging to original condition by the manufacturer. If Products are not returned in the original packaging the warranty will be void.
Refused or Cancelled Shipments:
Refused or cancelled shipments will be subject to a 25% restocking fee. Refused shipments carry freight charges that will have to paid by the customer to and from the customer's location. Freight charges are non refundable. A cancelled shipment is one for which a tracking number is available at the time of the request. All requests for cancellation are required in writing other than email and must be signed by the person who placed the order.
DOA (Dead on Arrival):
Products that are DOA must be reported to CDDVDKING, LLC within 3 business days after receipt. DOA or "dead on arrival" is defined as a Product that does not work after opening and installing the Product. Products that arrive DOA are covered by the manufacturer’s warranty. Customers can call 303-670-3234 or e-mail sales@cddvdking.com if a Product has failed within 3 days of receipt of product to request assistance in getting a RMA number. Once a defective Product is returned to the manufacturer in accordance with the above process, a replacement is sent out. Some manufacturers offer pre-swap out warranties that must be purchased within 30 days of initial purchase. After 3 days from the date of receipt of products, warranty work and correspondences will be handled directly by the manufacturer. Please contact our customer service department for any help that you might need in resolving warranty or RMA issues.
Taxes:
All prices do not include sales, local or other similar taxes. Where applicable, taxes will be shown on and added to your invoice. All such taxes shall be paid by the Customer.
Force Majeure:
CDDVDKING, LLC shall not be liable for any delay or failure in performance caused or resulting from acts of God, fire, flood, accident, riot, war, governmental intervention, embargo, strikes, labor difficulties, equipment failure or any other causes beyond the control of CDDVDKING, LLC.
Waiver:
Failure of CDDVDKING, LLC to insist upon strict enforcement of any of the provisions hereof shall not be deemed a waiver of its rights and remedies. If any provision of this agreement is deemed by a court to be unenforceable, the remainder shall stay in effect.
Pricing:
Prices and product specifications and availability are subject to changes without notice.
Technical Support:
The customer shall contact the manufacturer for technical support. The contact information for all manufacturers technical support is provided in a link entitled "Technical Support" on all pages of www.cddvdking.com. CDDVDKING LLC does not provide technical support for the Products it does not manufacture.
Shipping:
Ground-shipping times are estimates. We do not guarantee that all Products are in stock at all times. We make every effort to ship Products the same day. Some Products require lead time to manufacture, test and ship. Shipping costs are estimates only. You may be billed separately for some shipping expenses. Risk of loss or damage to Products in shipment is not CDDVDKING, LLCs responsibility.
Errors, Omission and Changes:
Prices and Specifications are subject to change without notice. All orders, prices and shipping rates are subject to confirmation, verification and correction. CDDVDKING, LLC is not responsible for typographical errors and or omissions that relate to pricing, copy, photography or specifications. If the price of a Product changes we will contact you by phone or email with the corrected pricing information, you will then have the right to place the order or decline placing the order.
Limitation of Liability:
CDDVDKING, LLC SHALL NOT BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY, OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF PRODUCTS ORDERED OR PURCHASED. CDDVDKING, LLC SHALL NOT BE LIABLE FOR ANY SPECIAL, DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES) IN ANY WAY DUE TO, RESULTING FROM, OR ARISING IN CONNECTION WITH THE USE OF OR INABILITY TO USE ANY PRODUCTS ORDERED OR PURCHASED. TO THE EXTENT THE FOREGOING LIMITATION OF LIABILITY IS PROHIBITED OR FAILS OF ITS ESSENTIAL PURPOSE, CDDVDKING, LLC’S SOLE OBLIGATION FOR DAMAGES SHALL BE LIMITED TO THE AMOUNT OF THE ORDER/PURCHASE.
Law:
These Terms shall be construed in accordance with the laws of Colorado without giving effect to its conflict of laws principles. The customer agrees in the event of a lawsuit to bring that lawsuit in Jefferson County Colorado Courts and to pay for all legal and collection fees of CDDVDKING LLC.
